What is a Construction Defect? According to The Code of Civil Procedure § 664.7 it is “Any civil action that seeks monetary recovery against a developer, builder, design professional, general contractor, material supplier, or subcontractor of any residential dwelling based upon a claim for alleged defects in the design or construction of a residential dwelling unit.” This definition is much simpler than the reality of construction defect litigation. Construction defect law has its roots in numerous legal disciplines and draws on concepts from the laws of contracts, torts, products liability, real property, corporations, and insurance. Concerns are rapidly increasing about the environmental aspects of the homes, the fields of toxic tort litigation and construction defect are merging into one.
